Terms of service
These Terms of Service ("Terms") govern your use of shopmoda39.com (the "Site") and any purchase made through it. The Site is operated by ELESTYLE1997 Corp, doing business as MODA39 ("we", "us"). By using the Site or placing an order you agree to these Terms.
Eligibility You must be at least 18 years old to place an order.
Products and pricing All prices are in US dollars and exclude applicable sales tax and shipping unless stated otherwise. We make every effort to display products and colours accurately, but cannot guarantee that your screen reproduces them exactly. We reserve the right to correct pricing errors, limit quantities, and refuse or cancel orders — including orders that appear to be placed by resellers.
Availability Our pieces are stocked in very limited quantities, often one per size. An item is reserved for you only once your order is confirmed. If an item becomes unavailable after your order is placed, we will contact you and issue a full refund for that item.
Orders and payment By placing an order you make an offer to purchase. We accept the order when we send a shipping or pickup confirmation. Payment is processed at the time of order through our payment provider. We may cancel orders we suspect to be fraudulent.
Shipping, returns and refunds Shipping and returns are governed by our Shipping Policy and Refund Policy, which form part of these Terms.
Discount codes and promotions Codes cannot be combined unless stated, have no cash value, and may be withdrawn at any time. Discounted items are final sale as set out in the Refund Policy.
Intellectual property All content on the Site — text, images, logos, layout — is owned by or licensed to ELESTYLE1997 Corp and may not be copied or used without written permission. Brand names of the designers we carry belong to their respective owners.
Accuracy of information We are not responsible for information on the Site that is inaccurate or out of date, and we may update content at any time without notice.
Limitation of liability To the fullest extent permitted by law, ELESTYLE1997 Corp shall not be liable for any indirect, incidental or consequential damages arising from your use of the Site or the purchase of products. Our total liability for any claim shall not exceed the amount you paid for the product concerned.
Governing law These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any dispute shall be brought in the state or federal courts located in Miami-Dade County, Florida.
Changes to these Terms We may update these Terms at any time. Continued use of the Site after changes are posted constitutes acceptance.
